    What Is A Short Sale?

    A short sale occurs when a borrower (you) owe more on the promissory note then can be paid if you were to sell the collateral (your house in this case). It’s nothing new, it happens all the time and has been around since loans were first made many hundreds of years ago. Today we just happen to see so many at this particular point. That doesn’t make it any better or easier, but you should know you are not in the life-boat alone and we can help you in most cases!

    That is a choice you can make, a bad one in my personal opinion.

    Foreclosure does not solve the problem of the home not being able to meet the debt owed, in fact it may make it worse!

    When a lender forecloses they often file for what is called a “deficiency judgment“. As well, it is often only the First Lien holder that forecloses and gets the property back to try and sell to recoup their losses. Any other lienholder is stuck and they will want their money in most cases. The Florida Laws regarding deficiency can be found HERE. Keep in mind the Statute Of Limitations – Chapter 95.11 allows for a lender to pursue that deficiency for UP TO TWENTY (20) YEARS!!!

    My friend did a short sale and said it was horrible.

    It is horrible, and it takes a lot of time and effort and the lender demands you use a REALTOR®, so then why not allow me to help you?

    I am seasoned and was doing short sales and pre-foreclosures way before all this mess began in 2007, (started doing them in 2001). I have a team that helps me to get the job done in a manner that is less of a headache for you and allows me to market the home so I can get us a contract so we can get the lender on board right a way AND you can then tell your lender you have an agent and they can contact me directly instead of pestering you about everything.

    There IS paperwork that must be done and just like when you received the loan they will want to see your finances to get out of the loan. Ask yourself this question … if say you owed $75,000 more then you could sell it for … and someone bought it and the lender forgave the debt … would roughly 20 hours of time be worth your while? Do the math – $75,000 / 20 is $3,750.00 per hour. How many hours would you have to work at your job to earn that “extra” $75,000 just to pay it off? We can apply that math to your situation just as easy. It may be more per hour or less … but chances are that it is substantial!!!

    My goal is to get them to “Forgive” the loan so you won’t have to worry about that deficiency on the loan. I can’t guarantee that all lien holders will forgive, but we can try to get them down to their lowest dollar amount and get them to release the lien so we can get the house freed up to be sold like a normal sale and not a foreclosure! No matter what the outcome it will most likely be better then letting it sit and “hoping” things will get better for you … no time like now to get it done … especially while lenders are working with homeowners like you to get homes done via short sale. There may come a time it is easier and better for them to go back to just foreclosing … so get it done while the getting is good!

    I was told I might owe taxes if they forgive the debt!

    At this time Congress continued The Mortgage Forgiveness Debt Relief Act that allows homeowners facing possible foreclosure that opted to short sale amnesty of that debt … but it was extended only until December 31, 2013.
