Do-not-call list could soon include text messages
TALLAHASSEE, Fla. – May 5, 2014
Florida legislators want to stop the proliferation of unwanted text messages Floridians receive with the passage of SB 450/HB 1191.
The bill sponsored by Senator Jeff Clemens and Representative Janet Cruz expands the “no sales solicitation calls” list maintained by the Department of Agriculture and Consumer Services to include voice, text or electronic communication through a landline, mobile or Internet telephone service.
The rule becomes effective July 1, 2014, assuming Gov. Rick Scott signs it into law, which is generally expected.
“People don’t want their personal and business correspondence cluttered up with unwanted text advertisements,” Clemens said. “It makes perfect sense to extend these privacies to newer forms of communication.”
With the creation of Do Not Call lists across the nation, consumers continue to be bombarded by solicitors using electronic communications, such as email and mobile text messaging. The Legislature intended to protect consumers from unsolicited sales communication, and phone calls in particular. The new law would extend those protections to deal with a changing communications environment.
The do-not-call rules apply to telemarketers, a category that includes real estate licensees. There are exceptions to the rules, however, such as a pre-existing business relationship.
